General Terms and Conditions (GTC)

Table of Contents
I. Scope
These General Terms and Conditions (GTC) govern the contractual relationship between Gisler Sport GmbH (hereinafter “Gisler Sport”) and all persons who purchase or use products or services provided by Gisler Sport.
These GTC apply to all types of contract, including in particular:
- the sale of products;
- the rental of sports equipment and other equipment;
- repair and maintenance services;
- boot fitting services; and
- test rentals and seasonal rentals.
They apply both to transactions concluded in a retail store and to bookings and purchases made through online platforms operated by Gisler Sport or by third-party providers.
Any deviating or supplementary terms and conditions of the customer shall be binding only if Gisler Sport has expressly accepted them in writing.
II. Definitions
Rental equipment: The term “rental equipment” means all items provided by Gisler Sport for temporary use. These include, in particular but without limitation:
- winter sports equipment such as skis, snowboards, cross-country skis and snowshoes;
- accessories such as ski poles and helmets;
- ski boots and snowboard boots;
- bicycles and e-bikes, including children’s bicycles;
- protective equipment such as protectors and helmets; and
- additional accessories such as locks and chargers.
III. Conclusion of Contract
A binding contract between Gisler Sport and the customer is concluded in the following cases:
- when an online booking made through a platform or website is confirmed. A booking can be made only if the customer actively accepts these GTC;
- when payment is made at the store checkout; or
- when the goods or services are actually handed over, used or provided.
Important information concerning the conclusion of a contract:
- The mere presentation of products, services or rental items on websites, in brochures or in stores does not constitute a legally binding offer.
- The availability of specific models or brands cannot be guaranteed.
- Gisler Sport reserves the right to provide equivalent replacement products.
Legal capacity and representation:
- Contracts may be concluded only by persons with full legal capacity.
- By concluding a contract, the customer confirms that they are at least 18 years old.
- If a person acts on behalf of a third party, that person confirms upon conclusion of the contract that they are legally authorised to represent the third party.
Information concerning the return of purchased items:
Unlike EU law, Swiss law does not provide for a general right of withdrawal for purchases made in a store or online.
Purchased items cannot be returned unless Gisler Sport expressly and voluntarily agrees to accept the return as a gesture of goodwill.
Returns granted as a gesture of goodwill are accepted only if the goods:
- are unused;
- are in perfect condition; and
- are in their original packaging.
In these cases, there is no entitlement to a refund of the purchase price.
IV. Ski Boot Fitting
1. Scope of Services
Gisler Sport offers individual adjustment of ski boots to the customer’s specific foot shape, known as boot fitting. This service is available both for ski boots purchased directly from Gisler Sport and for models purchased elsewhere.
Depending on the customer’s needs, boot fitting may include:
- heat moulding of liners;
- shaping of the shell to adjust its volume;
- grinding or punching out the shell at pressure points;
- adjustment of footbeds; and
- optimisation of the fit using insoles or other technical measures.
The service is generally subject to a fee unless it was expressly stated when the ski boots were purchased that boot fitting was included in the price.
2. Liability and Risk
Boot fitting is a manual and partly irreversible service. Its outcome is affected by the individual shape of the customer’s feet and their subjective perception of comfort. Therefore:
- no guarantee can be given that the boots will fit perfectly or remain free from discomfort;
- technical modifications to the ski boot shell are carried out at the customer’s express risk; and
- Gisler Sport is liable for damage only in cases of gross negligence.
3. Items Purchased Elsewhere
Where boot fitting is carried out on ski boots or insoles that were not purchased from Gisler Sport, all liability for changes to the material, impaired functionality or damage is excluded.
V. Workshop Services and Repair Conditions
1. Placing an Order and Cost Estimates
Gisler Sport carries out repairs and maintenance work on winter sports equipment and bicycles. The work is performed:
- by qualified specialists;
- in accordance with the current state of the art; and
- on the basis of a verbal or written order.
A cost estimate can be provided on request. If the actual work required exceeds the estimate by more than 20%, Gisler Sport will consult the customer before carrying out the additional work.
2. Exclusion of Liability for Used Items
For heavily worn or previously damaged equipment, Gisler Sport accepts no liability for consequential damage, particularly in the event of:
- material failure;
- subsequent breakage; or
- loss of functionality,
unless Gisler Sport has acted with gross negligence.
3. Collection and Acceptance
Repaired items must be collected within 10 days after completion.
Complaints must be submitted in writing within five days after collection.
Once this period has expired, the service is deemed to have been accepted.
4. Disposal of Irreparable Items
Items that are found to be irreparable after inspection and are not collected within 30 days may be disposed of by Gisler Sport.
There is no entitlement to the return of the item or to a replacement.
5. Hidden Damage
If defects that were not previously apparent are discovered while the work is being carried out, such as cracks, material fatigue or worn-through bases, the customer will be informed.
The rectification of such defects may be charged separately.
Liability for damage that was not detected is excluded unless Gisler Sport acted with gross negligence.
6. Definition of Gross Negligence
Gross negligence exists where a person breaches a fundamental duty of care to such a significant extent that the error could have been avoided with even minimal attention. Ordinary errors or mistakes do not constitute gross negligence.
VI. Rental Services
1. Right of Withdrawal and Cancellation
Swiss contract law does not provide for a general right of withdrawal or cancellation after a contract has been concluded. Rental equipment may be cancelled or returned only in accordance with the cancellation conditions set out below. This also applies to online bookings.
2. Reservations and Bookings
Rental items can be reserved directly in a store or through Gisler Sport’s online platform. The following applies to online bookings:
- the contract is concluded when Gisler Sport provides written confirmation, for example by email or booking confirmation; and
- complete and accurate customer information is required for a valid reservation.
Before the booking is completed, the customer is shown the essential information, including the rental period, price, cancellation conditions and these GTC.
3. Conclusion of Contracts Through Online Platforms
By submitting a booking that entails an obligation to pay, the customer makes a binding declaration that they wish to rent the equipment. The contract is concluded as soon as Gisler Sport sends a reservation confirmation. By making the booking, the customer accepts these GTC.
4. Third-Party Platforms
For bookings made through external platforms, the terms and conditions and privacy policies of those platforms also apply. Cancellations, refunds and changes to bookings are additionally governed by the conditions of the respective platform.
5. Prices and Binding Effect
The price shown at the time of booking is binding. Adjustments remain possible in the event of obvious pricing or system errors or changes to statutory charges.
6. Cancellation Conditions
- Free cancellation is possible up to 48 hours before the start of the rental period.
- For cancellation within 48 hours before the start of the rental period, 50% of the rental amount will be charged.
- In the event of a no-show without notice, the full rental amount is due.
7. Official Restrictions
In the event of officially imposed quarantine, travel bans or comparable restrictions, a refund may be granted upon presentation of official evidence, less the value of any services already provided.
8. Illness or Accident
If the rental equipment can no longer be used because of an accident or illness, a pro-rata refund may be granted provided that the equipment is returned immediately and a medical certificate is presented. Without a medical certificate, there is no entitlement to a refund.
9. Collection and Return
The rental equipment must be collected from the booked location no later than 11:00 a.m. on the first rental day. Any different opening hours at the location must be observed.
If the equipment is not collected on time, it may be allocated to another customer. There is no entitlement to a refund.
Collection and return take place at the booked location. A change of location is possible only by prior agreement with Gisler Sport.
The rental equipment must be returned on the last rental day no later than the end of the regular opening hours of the booked location. For online bookings, the provisions of the booking platform also apply.
If the equipment is returned after closing time or after the agreed return time, an additional rental day may be charged.
For an in-store rental, a return day booked as a rental day will not be charged if the equipment is returned between the opening of the store and 10:00 a.m. If it is returned later, but before the store closes, the full day will be charged.
10. Delayed Provision of Equipment
If delays occur because of late returns, defects or force majeure, Gisler Sport will endeavour to provide an equivalent replacement. There is no entitlement to compensation.
11. Customer Obligations
The rental equipment must be used properly and only for its intended purpose.
Obvious defects must be reported before the equipment is used.
The rental equipment may not be passed on to third parties or technically modified.
Use under the influence of alcohol or drugs is prohibited.
Unless expressly agreed otherwise, the rental equipment may not be used on unsuitable surfaces or in competitions or racing events for which it is not intended.
Damage, loss or theft must be reported to Gisler Sport immediately. Theft must also be reported to the police.
A valid photographic identity document may be requested upon collection. Proof of age may be required for children.
12. General Liability of the Customer
From the time the equipment is handed over until it is properly returned, the customer is responsible for its careful use, safe storage and protection against loss, theft and damage. The customer is also liable for damage caused by other users, particularly children.
13. Optional Theft and Breakage Insurance
Optional theft and breakage insurance may be taken out for winter sports rental equipment before it is handed over. The specific premium is shown in the booking, quotation or rental agreement before the contract is concluded. Insurance cover applies only if the insurance has been expressly agreed and the premium has been paid.
The following products may be insured:
- skis and snowboards;
- ski boots and snowboard boots;
- accessories rented with the equipment; and
- avalanche equipment and avalanche backpack packages, provided they are listed in the rental agreement.
The insurance covers:
- sudden and unforeseen breakage and damage arising from use in accordance with the contract; and
- theft of adequately secured rental equipment, provided the theft is reported immediately and a police report is filed.
The following are not covered in particular:
- loss, leaving behind or confusing the rental equipment with other equipment;
- intentional or grossly improper damage;
- damage caused by use contrary to the contract, unsuitable terrain, competitions or racing events without express agreement;
- use on asphalt, concrete, gravel, crushed stone, car parks, pavements, access roads or other surfaces without snow;
- improper storage, particularly in wet vehicles or unprotected outdoors overnight;
- damage and theft that are not reported immediately, as well as theft without a police report; and
- normal wear and signs of use.
The deductibles without insurance specified in Section 14 do not apply where valid insurance cover has been taken out. Any special deductibles or limitations will be disclosed before the contract is concluded.
14. No Insurance Taken Out
If no theft and breakage insurance has been taken out, the customer is liable for repair costs and, in the event of loss or total damage, up to the following deductibles. In the event of intentional or grossly improper damage, the customer is liable up to the equipment’s current value and the deductible limit does not apply.
- Economy / Kids / 4★: CHF 100.–
- Premium / 5★: CHF 300.–
- Exclusive / 6★: CHF 500.–
- Avalanche backpack: CHF 150.–
15. Goodwill Policy for Winter Sports Rentals
As a voluntary gesture of goodwill, Gisler Sport may choose not to charge for minor signs of use resulting from normal use or for defects that were not apparent upon return, such as fine scratches on the base or minor edge damage.
This goodwill policy is not insurance and does not create any legal entitlement to replacement, coverage of repair costs or a waiver of charges.
16. Changing Between Skis and a Snowboard
One change between skis and a snowboard is possible during the same rental period.
Within the 6★ category, one change of model is possible from the third rental day.
Each additional change is treated as a new rental and charged accordingly.
All changes are subject to the availability of the requested equipment.
17. Adjustment of the Rental Category
Following a professional assessment, Gisler Sport may adjust the booked category if it is unsuitable because of the customer’s skiing ability, height, build or intended use. The adjustment will be made in consultation with the customer. Any difference in price will be charged.
18. Avalanche Backpack Package
The avalanche backpack package includes:
- a backpack without ABS;
- an avalanche transceiver;
- a shovel;
- a probe; and
- an emergency kit.
Renting the avalanche backpack package does not replace the necessary experience or the proper preparation and assessment of avalanche and terrain conditions.
VII. Seasonal Rentals
1. Contractual Basis and Applicability
The conditions for seasonal rentals are based on a separate written agreement that the customer must sign before the rental begins.
These GTC apply in addition to the individual agreement, particularly to matters that are not expressly regulated in the seasonal rental agreement.
2. Rental Period and Return
The seasonal rental begins on the start date agreed in the contract and ends no later than the final official day of the winter season.
The last rental day is the end of the season defined by Bergbahnen Arosa on its official website.
The equipment must be returned complete and in perfect condition.
If the equipment is returned after the official end of the season, the deposit may be retained in part or in full.
3. Deposit
A deposit of CHF 50.– is charged for each seasonal rental. It will be credited in full if the equipment is returned on time and free from defects.
In the event of late return or damage to the equipment, Gisler Sport reserves the right to retain all or part of the deposit.
4. Insurance and Liability
The seasonal rental does not include insurance against:
- theft;
- loss; or
- damage.
The customer is fully responsible for:
- safe storage; and
- proper use of the equipment throughout the rental period.
5. Maintenance and Service
No maintenance service is included in the seasonal rental. Services such as:
- grinding the edges and base; or
- waxing the base
must be commissioned and paid for separately.
6. Written Form
The individual seasonal rental agreement must be signed before the rental begins. No equipment will be handed over without a signed agreement.
VIII. Test Rentals and Test Equipment
1. Purpose of the Test Rental
The test rental allows selected ski or snowboard models to be tested under real conditions. Its purpose is to provide the customer with a sound basis for deciding which model to purchase later.
2. Contractual Basis
The conditions of the test rental are based on a separate test rental agreement that must be signed in writing. This agreement is concluded with the customer when the test equipment is issued.
If there are any differences between these GTC and the individual agreement, the test rental agreement takes precedence.
3. Test Rental Prices
The cost of the test rental depends on the duration and number of products tested:
- One-day test of one ski or snowboard model: CHF 58.–
- One-day test of several models, for example two to three pairs of skis: CHF 100.–
- Multi-day test of up to a maximum of three days: CHF 200.–
The prices include the basic equipment but do not include insurance against damage or loss.
4. Credit When Purchasing
If the customer decides to purchase skis or a snowboard within seven days after the test:
- part of the test fee will be credited in accordance with the price list;
- a full refund of the test fee is excluded; and
- there is no guarantee that the tested model will be available for purchase.
5. Insurance
Insurance against loss, theft or damage is not included. The customer is fully liable for intentional damage or damage caused by gross negligence.
6. Customer Responsibility for Seeking Purchase Advice
It is in the customer’s interest and their responsibility to obtain information about available models, prices and conditions. Advice from specialist staff is available, but Gisler Sport is not obliged to offer it.
IX. Bicycle and E-Bike Rentals
1. Contractual Basis
By making a booking online or at the location, the customer accepts these GTC. No additional signature is required.
2. Conditions of Use
The rental equipment must be used carefully and only on designated routes and within its appropriate area of use.
Traffic regulations and statutory age and driving licence requirements must be observed. E-bikes may be used from the age of 16 or from the age of 14 with a Category M driving licence.
Races and competitions are not permitted without prior express agreement.
3. Inspection and Reporting of Defects
Before setting off, the rental equipment must be checked for visible defects, particularly to the brakes, gears and battery charge. Any defects must be reported immediately.
Technical defects for which the customer is not responsible do not constitute an insured event. Gisler Sport will rectify such defects within its operational capabilities or provide suitable replacement equipment.
4. Mandatory Basic Insurance
Mandatory basic insurance amounting to 10% of the regular standard rate is charged for bicycles and e-bikes. Discounts on the rental price do not alter the insurance amount. The insurance premium is shown separately and cannot be declined. Accessories are excluded.
The insurance covers:
- unforeseen damage caused by falls or accidents during use in accordance with the contract; and
- other unforeseen damage that is not attributable to an excluded event.
The following are not covered in particular:
- intentional or grossly improper damage;
- participation in races or competitions without express agreement;
- use in terrain or an area of use unsuitable for the rented bike; and
- loss of accessories and damage caused by unreported defects or unauthorised repairs.
Damage that is not covered will be charged according to the work required and the usual repair costs.
In the event of theft or total damage to the bicycle or e-bike, a deductible of CHF 1’500.– applies. Theft must be reported to Gisler Sport immediately and reported to the police.
5. Collection, Return and Location
Collection and return take place at the booked location. A change of location is possible only by prior agreement.
The bike must be returned on the last rental day at least one hour before closing time. Any different opening hours at the location must be observed.
An additional rental day may be charged if the bike is returned late.
6. Cleaning
The customer should not clean the bike before returning it. In particular, a pressure washer must not be used during multi-day rentals.
Normal dirt resulting from use in accordance with the contract is permitted. Exceptional soiling or improper cleaning may be assessed and charged according to the work required.
X. Payment Terms
1. Payment Methods
Gisler Sport accepts various payment methods to provide customers with a flexible and straightforward payment process. The following payment methods may be used in stores:
- cash;
- TWINT;
- debit cards, such as Maestro and PostFinance; and
- credit cards, including Visa and Mastercard.
For online bookings, only the payment methods displayed in the booking system are available. The amount is charged either immediately during the online booking process or at the location when the equipment or service is handed over.
2. Late Payment
If the customer does not meet their payment obligation by the due date, the following provisions apply:
- Gisler Sport reserves the right to charge default interest in accordance with Article 104 of the Swiss Code of Obligations;
- flat-rate reminder fees may be charged; and
- in the event of continued late payment, debt collection proceedings may be initiated. The customer must bear all associated costs.
3. Deposits and Advance Payments
Gisler Sport reserves the right to require a deposit or advance payment for certain product categories or services, particularly for custom-made products or longer-term reservations.
The amount and due date of the deposit will be clearly communicated at the time of booking.
If the customer cancels, the refund conditions specified in these GTC or in the individual contract apply.
XI. Data Protection
1. General Principles
Gisler Sport attaches great importance to protecting privacy and processing personal data in accordance with the law. All collected data is processed in compliance with the revised Swiss Federal Act on Data Protection.
2. Purpose of Data Collection
Personal data is used exclusively for:
- bookings;
- purchases;
- rental agreements;
- service orders; and
- customer support.
Information is disclosed to third parties only if this:
- is necessary for the performance of the contract, for example when payment is processed by a third-party provider; or
- is required by law.
3. Data Sources and Storage
Data may be collected:
- directly during a booking made in a store or online;
- when registering for newsletters; or
- in connection with customer enquiries or service orders.
Data is stored on protected systems in Switzerland or the European Economic Area. It is retained only for as long as necessary for the respective purpose or as required by law.
4. Rights of Data Subjects
Customers have the right at any time to:
- obtain information about stored data;
- have inaccurate data corrected;
- request erasure or restriction of processing, where legally permissible; and
- withdraw previously granted consent with effect for the future.
5. Data Protection on Third-Party Platforms
For bookings made through external booking or payment platforms, the privacy policies of the respective providers also apply. Gisler Sport has no influence over the processing of data by these third-party providers.

XII. Online Shop and Sale of Goods
1. Provider and Scope
This chapter applies to the sale of goods through an online shop operated by Gisler Sport. The provider and contractual partner is Gisler Sport GmbH, Poststrasse 178, 7050 Arosa.
The provisions governing rentals do not apply to purchases of goods unless expressly stated otherwise.
2. Products and Product Presentation
Product images and descriptions are provided for information purposes. Minor and objectively reasonable differences in colour, packaging or presentation remain possible.
The product characteristics displayed in the online shop at the time of the order are decisive.
3. Orders
The customer places the desired products in the shopping basket, checks the order information and submits a binding order using the appropriately labelled button.
Input errors can be identified and corrected before the order is submitted.
4. Conclusion of Contract and Order Confirmation
The presentation of products in the online shop does not generally constitute a binding offer.
The contract is concluded when Gisler Sport expressly accepts the order or sends a dispatch confirmation.
Once the order has been received, the customer will promptly receive an electronic acknowledgement of receipt or order confirmation.
5. Prices
The prices shown in the online shop in Swiss francs apply.
Statutory charges and mandatory surcharges are handled in accordance with the conditions shown in the online shop.
Shipping costs are displayed before the order is submitted.
6. Payment
The payment methods displayed in the online shop are available.
The timing and processing of the charge depend on the selected payment method and are shown during the ordering process.
7. Shipping Within Switzerland
Goods are shipped to the delivery address provided by the customer within the shipping areas offered in the online shop.
Available shipping methods and costs are displayed before the order is submitted.
8. Delivery Times
The delivery times stated for the product or during the ordering process apply.
Specified delivery dates are binding only if they have expressly been confirmed as binding.
9. Unavailability
If an ordered product is unavailable, Gisler Sport will inform the customer as soon as possible.
Payments already made for products that cannot be delivered will be refunded.
Further claims are excluded to the extent permitted by law.
10. Returns and Goodwill
Swiss law does not provide for a general right of withdrawal for ordinary online purchases.
Goods are accepted for return only if Gisler Sport expressly agrees to the return or voluntarily grants it as a gesture of goodwill.
The conditions and procedure for such a return will be communicated before the purchase or in the individual case.
Mandatory statutory rights in the event of defects remain reserved.
11. Defects and Warranty
The customer must inspect the goods after receipt and report any apparent defects immediately.
In the event of confirmed defects, the statutory provisions and any guarantee or warranty conditions expressly communicated in the online shop apply.
Mandatory statutory claims remain unaffected.
12. Product Information for Lucendro Ski Wax
The instructions concerning use, safety and storage shown on the product, its packaging and in the online shop apply to Lucendro ski wax.
The customer must observe these instructions before using the product.
Product variants and the scope of delivery are specified in the relevant product description.
13. Data Protection
The personal data required to process the contract is handled in connection with orders.
Information concerning payment, shipping and other service providers, as well as the rights of data subjects, can be found in Gisler Sport’s current Privacy Policy.
XIII. Final Provisions
1. Liability for Loss of Use
Gisler Sport accepts no liability for lost opportunities to use equipment or for consequential costs arising from circumstances such as:
- interruptions to the operation of cable cars or lifts;
- adverse weather conditions, such as insufficient snow or storms; or
- closures or restrictions imposed by authorities, such as pandemic-related measures.
2. Force Majeure and Impossibility of Performance
Neither party is liable for failure to fulfil its contractual obligations where this is attributable to events beyond its control. These include in particular:
- natural events, such as avalanches or severe weather;
- pandemics and epidemics;
- official orders;
- strikes or lockouts; and
- sudden failures of suppliers or logistics partners.
In such cases, Gisler Sport is entitled to withdraw from the contract without an obligation to provide compensation or to postpone performance.
3. Limitation Period and Notification of Defects
Claims against Gisler Sport become time-barred two years after the rental equipment is returned or the relevant service is completed, unless mandatory statutory provisions or more specific provisions of these GTC take precedence.
Defects must be reported in writing immediately after they are discovered.
If these GTC specify a particular reporting period for an individual service, particularly the five-day period for repair services, that specific provision takes precedence.
4. Contract Language and Archiving
The legally binding version of these GTC is written in German.
The GTC are archived in physical or electronic form.
In the event of any question of interpretation, the original German version prevails.
5. Governing Law and Jurisdiction
Swiss law applies exclusively, to the exclusion of conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods.
The place of jurisdiction is Arosa unless mandatory consumer protection provisions provide otherwise.
6. Limitation of Liability
Gisler Sport is liable only for direct damage caused intentionally or through gross negligence.
Any further liability, particularly for:
- indirect damage;
- consequential damage; or
- loss of profit,
is excluded to the extent permitted by law.
7. Availability and Delivery
Gisler Sport is not liable for delays in delivery, service interruptions or the unavailability of products caused by circumstances beyond its control, such as strikes, transport restrictions or official measures.
Gisler Sport will nevertheless always endeavour to provide an equivalent alternative solution.
8. Severability
If individual provisions of these GTC are invalid or unenforceable, the validity of the remaining provisions remains unaffected.
The invalid provision will be replaced by a provision that is as economically equivalent as possible.
9. Principle of Trust and Customer Support
Gisler Sport expects rental equipment to be handled carefully and is available to provide assistance with questions, uncertainties or problems throughout the term of the contract.
10. Written Form
Side agreements, amendments or additions to these GTC are effective only if confirmed in writing.
Conflicting terms and conditions of the customer do not apply, even if Gisler Sport does not expressly object to them.
11. Entry into Force
These General Terms and Conditions enter into force upon their approval and replace all previous versions.
