Scope<\/h3>\n<p>These General Terms and Conditions (GTC) govern the contractual relationships between Gisler Sport GmbH (hereinafter \u201cGisler Sport\u201d) and all persons who use Gisler Sport\u2019s products or services.<\/p>\n<p>These Terms and Conditions apply to all types of contracts, in particular to:<\/p>\n<ul>\n<li>the sale of products<\/li>\n<li>the rental of sports equipment and gear<\/li>\n<li>Repair and Maintenance Services<\/li>\n<li>Boat Fitting Services<\/li>\n<li>as well as trial and seasonal rentals<\/li>\n<\/ul>\n<p>These terms apply both to transactions made in-store and to orders and purchases made through Gisler Sport\u2019s online platforms or those of third-party providers.<\/p>\n<p>Any deviating or supplementary terms and conditions provided by customers shall be considered binding only if they have been expressly accepted in writing by Gisler Sport.<\/p>\n<h3 id=\"begriffsdefinitionen\">II. Definitions of Terms<\/h3>\n<p>Rental Equipment: The term \u201crental equipment\u201d refers to all items provided by Gisler Sport for temporary use. This includes, in particular, but is not limited to: <\/p>\n<ul>\n<li>Winter sports equipment (skis, snowboards, cross-country skis, snowshoes)<\/li>\n<li>Accessories such as ski poles, helmets<\/li>\n<li>Ski Boots and Snowboard Boots<\/li>\n<li>Bicycles and e-bikes (including children&#8217;s bikes)<\/li>\n<li>Protective gear (pads, helmets)<\/li>\n<li>as well as additional accessories such as locks or chargers<\/li>\n<\/ul>\n<h3 id=\"vertragsabschluss\">III. Conclusion of the Contract<\/h3>\n<p>A contract between Gisler Sport and its customers is binding in the following cases:<\/p>\n<ul>\n<li>by confirming an online reservation through a platform or website. The reservation can only be made if the customer actively accepts the Terms and Conditions. <\/li>\n<li>by paying at the register.<\/li>\n<li>or through the actual delivery and\/or use of the goods or services.<\/li>\n<\/ul>\n<p>Important Information Regarding the Conclusion of the Contract:<\/p>\n<ul>\n<li>The mere display of products, services, or rental items on websites, in flyers, or in-store does not constitute a legally binding offer.<\/li>\n<li>The availability of certain models or brands cannot be guaranteed.<\/li>\n<li>Gisler Sport reserves the right to provide equivalent replacement products.<\/li>\n<\/ul>\n<p>Legal Capacity and Representation:<\/p>\n<ul>\n<li>Contracts may only be entered into by persons with full legal capacity.<\/li>\n<li>By entering into this contract, the customer confirms that he or she is at least 18 years old.<\/li>\n<li>If a person is acting on behalf of a third party, by entering into the contract, that person confirms that they are legally authorized to represent that third party.<\/li>\n<\/ul>\n<p>Note on Returning Purchased Items:<\/p>\n<ul>\n<li>Unlike EU law, Swiss law does not provide for a general right of withdrawal for in-store or online purchases.<\/li>\n<li>Purchased items cannot be returned unless Gisler Sport expressly and voluntarily grants a return as a gesture of goodwill.<\/li>\n<li>Returns as a gesture of goodwill will only be accepted if:<\/li>\n<li>the merchandise, unused<\/li>\n<li>in perfect condition and<\/li>\n<li>is in its original packaging.<\/li>\n<li>In these cases, there is no right to a refund of the purchase price.<\/li>\n<\/ul>\n<h3 id=\"bootfitting\">IV. Ski Boot Fitting<\/h3>\n<h4>1. Scope of Services<\/h4>\n<p>Gisler Sport offers custom adjustments to ski boots to fit each customer\u2019s specific foot shape (known as \u201cboot fitting\u201d). This service applies to both ski boots purchased directly from Gisler Sport and models purchased elsewhere. <\/p>\n<p>Depending on your needs, the following customization options can be included in the boat fitting:<\/p>\n<ul>\n<li>Heat-Molding of Inner Boots<\/li>\n<li>Shell Deformation for Volume Adjustment<\/li>\n<li>Milling or Dent Removal on Pressure Marks<\/li>\n<li>Insole Fitting<\/li>\n<li>Fit adjustments using insoles or other technical measures<\/li>\n<\/ul>\n<p>There is usually a fee for this service, unless it was explicitly stated at the time of purchase that boot fitting was included in the price of the ski boots.<\/p>\n<h4>2. Liability and Risk<\/h4>\n<p>Boot fitting is a craft-based, partly irreversible service, the outcome of which is influenced by the individual shape of the foot as well as the user\u2019s subjective sense of comfort. Therefore: <\/p>\n<ul>\n<li>We cannot guarantee a perfect fit or that you will be free of discomfort.<\/li>\n<li>Any technical modifications made to the ski boot shell are at the customer&#8217;s own risk.<\/li>\n<li>Gisler Sport is liable for damages only in cases of gross negligence.<\/li>\n<\/ul>\n<h4>3. Items You Bring With You<\/h4>\n<p>In the case of boot-fitting services performed on ski boots or insoles not purchased from Gisler Sport, we assume no liability for:<\/p>\n<ul>\n<li>Changes in materials,<\/li>\n<li>Functional impairments or<\/li>\n<li>Damage<\/li>\n<\/ul>\n<p>excluded.<\/p>\n<h3 id=\"werkstattservice\">V. Workshop Services &#038; Repair Terms and Conditions<\/h3>\n<h4>1. Placing an Order and Cost Estimate<\/h4>\n<p>Gisler Sport performs repair and maintenance work on winter sports equipment and bicycles. The work is carried out: <\/p>\n<ul>\n<li>by qualified professionals,<\/li>\n<li>in accordance with the current state of the art<\/li>\n<li>based on a verbal or written order<\/li>\n<\/ul>\n<p>A cost estimate can be provided upon request. If the actual cost exceeds the estimate by more than 20%, we will consult with the customer before proceeding. <\/p>\n<h4>2. Disclaimer Regarding Used Items<\/h4>\n<p>In the case of heavily worn or previously damaged equipment, Gisler Sport assumes no liability for consequential damages, particularly in the following cases:<\/p>\n<ul>\n<li>Material Failure<\/li>\n<li>Subsequent fractures or<\/li>\n<li>Loss of function<\/li>\n<\/ul>\n<p>unless there is gross negligence on the part of Gisler Sport.<\/p>\n<h4>3. Return &#038; Acceptance<\/h4>\n<ul>\n<li>Repaired items must be picked up within 10 days of completion.<\/li>\n<li>Complaints must be submitted in writing within 5 days of pickup.<\/li>\n<li>Once this period has expired, the service is deemed to have been approved.<\/li>\n<\/ul>\n<h4>4. Disposal of Irreparable Items<\/h4>\n<ul>\n<li>Items that are deemed irreparable after inspection and are not picked up within 30 days may be disposed of by Gisler Sport.<\/li>\n<li>There is no right to a refund or replacement.<\/li>\n<\/ul>\n<h4>5. Hidden Damage<\/h4>\n<ul>\n<li>If any defects that were not apparent during processing are discovered (e.g., cracks, material fatigue, worn-through surfaces), the customer will be notified.<\/li>\n<li>The cost of correcting such defects may be billed separately.<\/li>\n<li>Liability for overlooked damages is excluded, unless there is gross negligence.<\/li>\n<\/ul>\n<h4>6. Definition of Gross Negligence<\/h4>\n<p>Gross negligence occurs when a person violates a fundamental duty of care to such a significant degree that the error could have been avoided even with minimal attention. Ordinary mistakes or errors are not considered gross negligence. <\/p>\n<h3 id=\"verleihservice\">VI. Rental Service<\/h3>\n<h4>1. Right of Withdrawal and Right to Cancel<\/h4>\n<p>The Swiss Code of Obligations does not provide for a general right of revocation or withdrawal after the contract has been concluded. Cancellation or return of rental equipment is only possible in accordance with the following cancellation policy. This also applies to online reservations.  <\/p>\n<h4>2. Reservation and Booking<\/h4>\n<p>Rental items can be reserved directly in-store or through Gisler Sport\u2019s online platform. The following applies to online reservations: <\/p>\n<ul>\n<li>The contract is concluded upon written confirmation by Gisler Sport, for example via email or a booking confirmation.<\/li>\n<li>Entering complete and accurate customer information is required for a valid reservation.<\/li>\n<li>Before the booking is finalized, customers are provided with key information, including, in particular, the rental period, price, cancellation policy, and these Terms and Conditions.<\/li>\n<\/ul>\n<h4>3. Conclusion of Contracts via Online Platforms<\/h4>\n<p>By submitting a booking that requires payment, the customer makes a binding request to rent the equipment. The contract is considered concluded as soon as Gisler Sport has sent a reservation confirmation. By making the booking, the customer accepts these Terms and Conditions.  <\/p>\n<h4>4. Third-Party Platforms<\/h4>\n<p>For bookings made through external platforms, those platforms\u2019 terms and conditions and privacy policies also apply. Cancellations, refunds, and rescheduling are also subject to the terms and conditions of the respective platform. <\/p>\n<h4>5. Price Information and Fixed Prices<\/h4>\n<p>The price shown at the time of booking is final. We reserve the right to make adjustments in the event of obvious pricing or system errors, as well as changes to statutory taxes and fees. <\/p>\n<h4>6. Cancellation Policy<\/h4>\n<ul>\n<li>Free cancellation: up to 48 hours before the start of the rental period.<\/li>\n<li>Cancellation within 48 hours before the start of the rental period: 50% of the rental fee will be charged.<\/li>\n<li>No-show without notice: The full rental amount is due.<\/li>\n<\/ul>\n<h4>7. Regulatory Restrictions<\/h4>\n<p>In the event of a government-mandated quarantine, travel bans, or similar restrictions, a refund may be issued upon presentation of official documentation, minus the cost of any services already provided.<\/p>\n<h4>8. Illness or Accident<\/h4>\n<p>If the rented equipment can no longer be used due to an accident or illness, a pro-rata refund may be issued, provided that the equipment is returned immediately and a doctor&#8217;s note is submitted. Without a doctor&#8217;s note, there is no entitlement to a refund. <\/p>\n<h4>9. Pickup and Return<\/h4>\n<ul>\n<li>The rental equipment must be picked up at the booked location by 11:00 a.m. at the latest on the first day of the rental period. Please note any different opening hours at the location. <\/li>\n<li>If the materials are not picked up on time, they may be allocated to another party; there is no right to a refund.<\/li>\n<li>Pickup and return take place at the location where the reservation was made. A change of location is only possible after prior consultation with Gisler Sport. <\/li>\n<li>The vehicle must be returned on the last day of the rental period, no later than the end of regular business hours at the booked location. For online reservations, the terms and conditions of the booking platform also apply. <\/li>\n<li>If the equipment is returned after business hours or after the agreed-upon return time, an additional day&#8217;s rental fee may be charged.<\/li>\n<li>For in-store rentals, a return date booked as a rental day will not be charged if the item is returned between store opening and 10:00 a.m. If the item is returned later, up until closing time, the full day will be charged. <\/li>\n<\/ul>\n<h4>10. Delayed Delivery<\/h4>\n<p>If delays occur due to late returns, defects, or force majeure, Gisler Sport will make every effort to provide an equivalent replacement. There is no entitlement to compensation. <\/p>\n<h4>11. Customer Responsibilities<\/h4>\n<ul>\n<li>The rental equipment must be used properly and only for its intended purpose.<\/li>\n<li>Any obvious defects must be reported before use.<\/li>\n<li>The rental equipment may not be transferred to third parties or modified in any way.<\/li>\n<li>Use while under the influence of alcohol or drugs is prohibited.<\/li>\n<li>The rental equipment may not be used on unsuitable surfaces or in competitions or racing events for which it was not intended, unless this has been expressly agreed upon.<\/li>\n<li>Any damage, loss, or theft must be reported to Gisler Sport immediately. In the event of theft, a police report is also required. <\/li>\n<li>A valid photo ID may be required at the time of pickup. Proof of age may be required for children. <\/li>\n<\/ul>\n<h4>12. General Liability of Customers<\/h4>\n<p>From the time of pickup until the equipment is properly returned, the customer is responsible for the careful use, safe storage, and protection of the rented equipment against loss, theft, and damage. The customer is also liable for any damage caused by other users, particularly children. <\/p>\n<h4>13. Optional Theft and Breakage Insurance<\/h4>\n<p>For winter sports rental equipment, optional theft and damage insurance can be purchased before pickup. The specific premium will be listed in the booking confirmation, the quote, or the rental agreement before the contract is signed. Insurance coverage is valid only if the insurance has been expressly agreed upon and the premium has been paid.  <\/p>\n<p>Insurable products:<\/p>\n<ul>\n<li>Skis and Snowboards<\/li>\n<li>Ski Boots and Snowboard Boots<\/li>\n<li>Accessories included in the rental<\/li>\n<li>Avalanche equipment and avalanche backpack packages, provided they are listed in the rental agreement<\/li>\n<\/ul>\n<p>The following are covered:<\/p>\n<ul>\n<li>Sudden and unforeseen breakage or damage resulting from use in accordance with the contract<\/li>\n<li>Theft of rental equipment that has been adequately secured, provided that the theft is reported immediately and a police report is filed<\/li>\n<\/ul>\n<p>In particular, the following are not covered:<\/p>\n<ul>\n<li>Loss, Abandonment, or Mix-Up of Rental Equipment<\/li>\n<li>intentional or grossly negligent damage<\/li>\n<li>Damage resulting from use in violation of the contract, unsuitable terrain, competitions, or racing events without express agreement<\/li>\n<li>For use on asphalt, concrete, gravel, or crushed stone surfaces, parking lots, sidewalks, driveways, or other snow-free surfaces<\/li>\n<li>Improper storage, especially in wet vehicles or left unprotected outdoors overnight<\/li>\n<li>Damage and thefts that are not reported immediately, as well as thefts not reported to the police<\/li>\n<li>normal wear and tear<\/li>\n<\/ul>\n<p>The deductibles without insurance specified in Section 14 do not apply if insurance coverage has been validly purchased. Any special deductibles or restrictions will be disclosed before the contract is concluded. <\/p>\n<h4>14. No insurance policy has been purchased<\/h4>\n<p>If no theft and breakage insurance has been purchased, the customer is liable for repair costs as well as for loss or total damage up to the deductibles listed below. In the event of intentional damage or grossly negligent damage, the customer is liable up to the current market value; the deductible limit does not apply. <\/p>\n<ul>\n<li>Economy \/ Kids \/ 4\u2605: CHF 100.\u2013<\/li>\n<li>Premium \/ 5\u2605: CHF 300.\u2013<\/li>\n<li>Exclusive \/ 6\u2605: CHF 500.\u2013<\/li>\n<li>Avalanche backpack: CHF 150.\u2013<\/li>\n<\/ul>\n<h4>15. Good-Faith Policy for Winter Sports Rentals<\/h4>\n<p>Gisler Sport may, as a gesture of goodwill, overlook minor signs of wear resulting from normal use and defects that are not apparent upon return, such as fine scratches on the base or minor edge damage. This goodwill policy is not insurance and does not constitute a legal claim to replacement, coverage of repair costs, or waiver of charges. <\/p>\n<h4>16. Changing Skis and Snowboards<\/h4>\n<ul>\n<li>You may switch between skis and a snowboard once during the same rental period.<\/li>\n<li>Within the 6\u2605 category, a one-time model change is permitted starting on the third day of the rental.<\/li>\n<li>Any additional change is considered a new rental and will be billed accordingly.<\/li>\n<li>Replacements are subject to the availability of the desired material.<\/li>\n<\/ul>\n<h4>17. Adjustment of the rental category<\/h4>\n<p>Gisler Sport reserves the right to adjust the booked category based on a professional assessment if it is deemed unsuitable due to skiing ability, height, physique, or intended use. The adjustment will be made in consultation with the customer. Any price differences will be billed.  <\/p>\n<h4>18. Avalanche Backpack Package<\/h4>\n<p>The avalanche backpack package includes:<\/p>\n<ul>\n<li>Backpack without ABS<\/li>\n<li>Avalanche transceiver<\/li>\n<li>Shovel<\/li>\n<li>Probe<\/li>\n<li>Emergency Kit<\/li>\n<\/ul>\n<p>Renting the avalanche backpack package does not replace the necessary experience or proper preparation and assessment of avalanche and terrain conditions.<\/p>\n<h3 id=\"saisonmiete\">VII. Seasonal Rent<\/h3>\n<h4>1. Basis of the Agreement and Applicability<\/h4>\n<p>The terms and conditions for seasonal rentals are based on a separate, signed written agreement that customers must sign before the rental begins.<\/p>\n<p>These General Terms and Conditions apply in addition to the individual agreement, particularly with regard to matters not explicitly covered in the seasonal rental agreement.<\/p>\n<h4>2. Rental Period and Return<\/h4>\n<p>The seasonal lease begins on the start date specified in the contract and ends no later than the last official day of the winter season.<\/p>\n<ul>\n<li>The last day of rental is the end of the season as defined by Bergbahnen Arosa, according to their official website.<\/li>\n<li>The equipment must be returned in its entirety and in perfect condition.<\/li>\n<li>If the return is made after the official end of the season, the deposit may be withheld in part or in full.<\/li>\n<\/ul>\n<h4>3. Brokerage Account<\/h4>\n<p>A security deposit of CHF 50.\u2013 is charged for each seasonal rental. This deposit will be credited in full upon timely return of the property in good condition. <\/p>\n<ul>\n<li>In the event of a late return or if damage to the equipment is discovered, Gisler Sport reserves the right to withhold all or part of the deposit.<\/li>\n<\/ul>\n<h4>4. Insurance and Liability<\/h4>\n<p>The seasonal rental does not include insurance against:<\/p>\n<ul>\n<li>Theft,<\/li>\n<li>Loss or<\/li>\n<li>Damage<\/li>\n<\/ul>\n<p>Customers are fully responsible for:<\/p>\n<ul>\n<li>safe storage,<\/li>\n<li>the proper use of the equipment throughout the entire rental period.<\/li>\n<\/ul>\n<h4>5. Maintenance and Service<\/h4>\n<p>Seasonal rentals do not include maintenance services. Services such as: <\/p>\n<ul>\n<li>Sand the edges and the surface, or<\/li>\n<li>Wax the base<\/li>\n<\/ul>\n<p>must be ordered and paid for separately.<\/p>\n<h4>6. Written Form<\/h4>\n<p>A signed copy of the individual seasonal rental agreement is required before the rental period can begin. No equipment will be issued without a signed agreement. <\/p>\n<h3 id=\"testmiete\">VIII. Test Rentals \/ Test Materials<\/h3>\n<h4>1. Purpose of the Trial Lease<\/h4>\n<p>The purpose of the test rental is to try out selected ski or snowboard models under real-world conditions. The goal is to provide customers with reliable guidance to help them make an informed decision when they eventually make a purchase. <\/p>\n<h4>2. Basis of the Contract<\/h4>\n<p>The terms of the trial rental are set forth in a separate trial rental agreement that must be signed in writing. This agreement is entered into with the customer as part of the trial rental process. <\/p>\n<p>In the event of any discrepancies between these Terms and Conditions and the individual agreement, the trial lease agreement shall take precedence.<\/p>\n<h4>3. Prices for Trial Rentals<\/h4>\n<p>The cost of the trial rental depends on the duration and the number of products tested:<\/p>\n<ul>\n<li>One-day rental of a single ski or snowboard: CHF 58.\u2013<\/li>\n<li>One-day test of several models (e.g., 2\u20133 pairs of skis): CHF 100.\u2013<\/li>\n<li>Multi-day test (up to 3 days): CHF 200.\u2013<\/li>\n<\/ul>\n<p>Prices include basic equipment but do not include insurance against damage or loss.<\/p>\n<h4>4. Credit toward Purchase<\/h4>\n<p>If customers decide to purchase a pair of skis or a snowboard within 7 days of the test:<\/p>\n<ul>\n<li>A portion of the test fee, as specified in the price list, will be credited.<\/li>\n<li>A full refund is not possible.<\/li>\n<li>There is no guarantee that the tested model will be available for purchase.<\/li>\n<\/ul>\n<h4>5. Insurance<\/h4>\n<p>Insurance against loss, theft, or damage is not included. Customers are fully liable for damage caused by willful acts or gross negligence. <\/p>\n<h4>6. Initiative on Purchasing Advice<\/h4>\n<p>It is in the customers\u2019 best interest and their responsibility to actively seek information about available models, prices, and terms. Consultation with our expert staff is available, but Gisler Sport is under no obligation to provide it. <\/p>\n<h3 id=\"bikevermietung\">IX. Bicycle and E-Bike Rentals<\/h3>\n<h4>1. Basis of the Contract<\/h4>\n<p>By making a reservation\u2014whether online or in person\u2014customers agree to these Terms and Conditions. No additional signature is required. <\/p>\n<h4>2. Terms of Use<\/h4>\n<ul>\n<li>The rental equipment must be used with care and only on designated paths and within the appropriate area of use.<\/li>\n<li>Traffic rules and the legal age and driver&#8217;s license requirements must be followed; e-bikes may be used by individuals 16 years of age or older, or by those 14 years of age or older who hold a Category M driver&#8217;s license.<\/li>\n<li>Races and competitions are not permitted without prior express agreement.<\/li>\n<\/ul>\n<h4>3. Inspection and Reporting of Defects<\/h4>\n<p>Before setting out, the rental equipment must be inspected for visible defects, particularly in the brakes, gears, and battery charge. Any defects found must be reported immediately. Technical defects not caused by the customer are not covered by insurance and will be repaired by Gisler Sport to the extent operationally feasible or resolved by providing suitable replacement equipment.  <\/p>\n<h4>4. Mandatory Basic Insurance<\/h4>\n<p>For bicycles and e-bikes, a mandatory basic insurance premium equal to 10% of the regular standard rate is charged. Discounts on the rental price do not affect the insurance amount. The insurance premium is listed separately and cannot be opt out of. Accessories are excluded from this coverage.   <\/p>\n<p>The following are covered:<\/p>\n<ul>\n<li>unforeseen damage caused by falls or accidents during use in accordance with the contract<\/li>\n<li>other unforeseen damage that is not attributable to an excluded cause<\/li>\n<\/ul>\n<p>In particular, the following are not covered:<\/p>\n<ul>\n<li>intentional or grossly negligent damage<\/li>\n<li>Participation in races or competitions without an express agreement<\/li>\n<li>Use on terrain or in an environment unsuitable for the rented bike<\/li>\n<li>Loss of accessories, as well as damage caused by unreported defects or unauthorized repairs<\/li>\n<\/ul>\n<p>Damages not covered by the policy will be billed at cost based on standard repair rates. In the event of theft or total loss of the bicycle or e-bike, an deductible of CHF 1,500 applies; theft must be reported to Gisler Sport immediately and reported to the police. <\/p>\n<h4>5. Pickup, Return, and Location<\/h4>\n<ul>\n<li>Pickup and return take place at the booked location. A change of location is possible only by prior arrangement. <\/li>\n<li>The return must take place on the last day of the rental, at least one hour before closing time. Please note any different opening hours at the location. <\/li>\n<li>If the vehicle is returned late, an additional day&#8217;s rental fee may be charged.<\/li>\n<\/ul>\n<h4>6. Cleaning<\/h4>\n<p>Customers should not clean the bike before returning it. For multi-day rentals, high-pressure washers, in particular, must not be used. Normal soiling resulting from use in accordance with the contract is permitted; excessive soiling or improper cleaning may be assessed on a case-by-case basis.  <\/p>\n<h3 id=\"zahlungsbedingungen\">X. Terms of Payment<\/h3>\n<h4>1. Payment Methods<\/h4>\n<p>Gisler Sport accepts various payment methods to provide customers with a flexible and easy payment process. The following payment methods can be used in-store: <\/p>\n<ul>\n<li>Cash payment<\/li>\n<li>TWINT<\/li>\n<li>Debit cards (e.g., Maestro, PostFinance)<\/li>\n<li>Credit cards (Visa, Mastercard).<\/li>\n<\/ul>\n<p>For online bookings, only the payment methods displayed in the booking system are accepted. The charge will be processed immediately as part of the online booking or on-site upon delivery of the equipment or service. <\/p>\n<h4>2. Late Payment<\/h4>\n<p>If the customer fails to fulfill their obligation by the due date, the following provisions apply:<\/p>\n<ul>\n<li>Gisler Sport reserves the right to charge interest on late payments in accordance with Art. 104 of the Swiss Code of Obligations.<\/li>\n<li>Flat-rate late fees may be charged for late payments.<\/li>\n<li>In the event of persistent late payment, debt collection proceedings may be initiated, in which case the customer will be responsible for all associated costs.<\/li>\n<\/ul>\n<h4>3. Down Payments and Advance Payments<\/h4>\n<p>Gisler Sport reserves the right to require a deposit or advance payment for certain product categories or services\u2014particularly for custom-made items or long-term reservations. The amount of the deposit and its due date will be clearly communicated at the time of booking. <\/p>\n<p>In the event of a cancellation by the customer, the refund terms set forth in the Terms and Conditions or in the individual contract shall apply.<\/p>\n<h3 id=\"datenschutz\">XI. Online Store and Sale of Goods<\/h3>\n<h4>1. Provider and Scope of Application<\/h4>\n<p>This chapter applies to the sale of goods through an online store operated by Gisler Sport. The seller and contracting party is Gisler Sport GmbH, Poststrasse 178, 7050 Arosa. Provisions regarding rentals do not apply to purchases of goods, unless expressly stated otherwise.  <\/p>\n<h4>2. Products and Product Presentation<\/h4>\n<p>Product images and descriptions are for informational purposes only. We reserve the right to make minor, reasonable changes to color, packaging, or presentation. The product specifications displayed in the online store at the time of order are binding.  <\/p>\n<h4>3. Order<\/h4>\n<p>Customers add the desired products to their shopping cart, review the order details, and submit a binding order by clicking the appropriately labeled button. Any input errors can be identified and corrected before the order is submitted. <\/p>\n<h4>4. Conclusion of the Contract and Order Confirmation<\/h4>\n<p>The product listings in the online store do not, in principle, constitute a binding offer. Statute of Limitations and Notifications of Defects<\/h4>\n<p>Claims against Gisler Sport are subject to a two-year statute of limitations beginning on the date the rental equipment is returned or the relevant service is completed, unless mandatory statutory provisions or more specific provisions of these Terms and Conditions take precedence.<\/p>\n<p>Defects must be reported in writing immediately upon discovery. Availability and Delivery<\/h4>\n<p>Gisler Sport is not liable for delivery delays, service interruptions, or product unavailability due to circumstances beyond its control (e.g., strikes, transportation restrictions, government measures). However, we will always strive to provide an equivalent alternative solution. <\/p>\n<h4>8. Severability Clause<\/h4>\n<p>If any provision of these Terms and Conditions is invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that is as economically equivalent as possible. <\/p>\n<h4>9. Rule of Trust and Customer Care<\/h4>\n<p>Gisler Sport expects the rental equipment to be handled with care and is available at any time to provide assistance with questions, concerns, or problems that may arise during the term of the contract.<\/p>\n<h4>10. Written Form<\/h4>\n<p>Any side agreements, amendments, or additions to these Terms and Conditions are effective only if they have been confirmed in writing. Any conflicting terms and conditions of the customer shall not apply\u2014even without an express objection by Gisler Sport. <\/p>\n<h4>11.
